These Terms and Conditions govern your use of elgrowers.com (the “Site”), operated by E&L Growers. By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Use of the Site

Permitted Use: You may use this Site to browse products, place preorders for farmers market pickup, manage a CSA subscription, and interact with your E&L Growers account.

Prohibited Use: You may not use this Site to distribute spam, post harmful content, attempt to gain unauthorized access, scrape or copy content for commercial purposes, or use the Site in any way that violates applicable laws.

Accounts and Registration

To place preorders or subscribe to a CSA plan, you must create an account. You agree to provide accurate and complete information during registration, including your name, email address, and phone number. You are responsible for maintaining the security of your account credentials.

By creating an account and providing your phone number, you may opt in to receive transactional SMS text messages from E&L Growers, including order confirmations, pickup reminders, and CSA subscription updates. See the SMS Text Messaging section below for full details.

Preorders and Purchases

Ordering: Preorders placed through this Site are for pickup at designated Heirloom Farmers Market locations in Tucson, Arizona. All orders are subject to product availability.

Pricing: Prices are listed in U.S. dollars and are subject to change without notice. We make every effort to ensure pricing accuracy, but errors may occur. If we discover a pricing error after you place an order, we will contact you before processing.

Payment: Payment is processed securely through Stripe. We do not store your credit card information on our servers.

Pickup: Orders must be picked up at the designated market location on the scheduled market day. You will receive a pickup code via SMS and/or email. Unclaimed orders are not eligible for refund.

CSA Subscriptions

CSA (Community Supported Agriculture) subscriptions are recurring plans billed on a regular schedule. By subscribing, you authorize E&L Growers to charge your payment method on file for each billing period. You may cancel or modify your subscription through your account settings or by contacting us.

CSA subscription terms, including pause policies and tier details, are described on the CSA page of our website and may be updated from time to time.

SMS Text Messaging

By creating an account on elgrowers.com and opting in to receive text messages, you consent to receive SMS messages from E&L Growers. Messages may include:

• Order confirmation texts with your pickup code

• Pickup reminders on market day

• CSA subscription updates (pause confirmations, renewal reminders)

• Order receipts

Message frequency varies based on your order activity. Message and data rates may apply.

You can opt out at any time by replying STOP to any message or by toggling off text notifications in your account settings at elgrowers.com/my-account. Reply HELP for assistance. Opting out of SMS will not affect your ability to place orders or manage your account.

Your consent to receive SMS messages is not a condition of purchase. You may use the Site and place orders without opting in to text messages.

Newsletter

By subscribing to our email newsletter, you consent to receive periodic emails containing market updates, product availability, and related content. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us directly.

Intellectual Property
